1. Acceptance of Terms

These Terms of Use ("Terms") constitute a legally binding agreement between you and Based ("we", "us", "our", or "Developer") regarding your use of the Based mobile application ("App").

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the App.

2. Description of Service

Based is a mobile application that provides:

Daily motivational quotes and affirmations
Customizable notification schedules
Streak tracking for daily engagement
Category-based quote personalization
Premium features available through subscription

3. Eligibility

You must be at least 13 years of age (or the applicable age of digital consent in your jurisdiction) to use this App. By using the App you represent that you meet this requirement.

If you are under 18, you represent that you have obtained parental or guardian consent to use the App.

4. License Grant and Restrictions

4.1 License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on devices you own or control solely for personal, non-commercial use.

4.2 Restrictions

You agree NOT to:

Modify, reverse engineer, decompile, or disassemble the App
Remove or alter proprietary notices from the App
Use the App for illegal or harmful purposes
Attempt unauthorized access to the App or its systems
Use bots, scripts, or automated tools with the App
Interfere with the App's functionality or servers
Distribute or sell the App
Impersonate another person or entity
Upload malicious software or viruses
Violate applicable laws or third-party rights

5. User Accounts and Data

5.1 Account Creation

The App may use third-party services such as RevenueCat to manage subscriptions. You are responsible for maintaining the confidentiality of your account information.

5.2 User Data

You retain rights to any custom content you create within the App. By using the App you grant us permission to process your data as described in our Privacy Policy.

5.3 Accuracy of Information

You agree to provide accurate information during onboarding and to update information if it becomes inaccurate.

6. Premium Subscriptions

6.1 Subscription Terms

Certain features of the App require a paid subscription ("Premium Features"). Subscriptions are processed through Apple's App Store or Google Play Store and subject to their terms.

6.2 Payment

Subscriptions are charged to your App Store or Play Store account.
Payment occurs upon confirmation of purchase.
Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current billing period.
You may manage or cancel subscriptions through your store account settings.

6.3 Free Trials

Free trials may be offered for Premium Features. Charges may apply after the trial period unless cancelled beforehand.

6.4 Pricing Changes

We reserve the right to modify subscription pricing. Existing subscribers will receive notice before price changes take effect.

7. Intellectual Property Rights

7.1 Ownership

The App including its software, design, graphics, and content is owned by the Developer and protected by intellectual property laws.

7.2 Third-Party Content

Some quotes or content may originate from third-party sources or public domain materials.

7.3 User-Generated Content

Custom quotes or themes you create remain your property and are stored locally on your device.

7.4 Trademarks

"Based" and associated branding elements are trademarks of the Developer and may not be used without permission.

8. Disclaimer

THE APP DOES NOT PROVIDE MEDICAL OR MENTAL HEALTH ADVICE.

Quotes and motivational content are for informational and inspirational purposes only and should not replace professional medical advice, diagnosis, or treatment.

9. Disclaimer of Warranties

To the maximum extent permitted by law, the App is provided "as is" without warranties of any kind including merchantability, fitness for a particular purpose, or non-infringement.

EU consumers retain statutory rights under applicable consumer protection laws.

10. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages including loss of profits, business interruption, or loss of data.

Our total liability shall not exceed the greater of the amount you paid in the previous twelve months or €100, unless otherwise required by EU consumer protection laws.

11. Third-Party Services

The App may integrate third-party services such as RevenueCat, Supabase, Sentry, or analytics providers. We are not responsible for their availability, content, or privacy practices.

12. Modifications

We may modify or discontinue the App or update these Terms at any time. Continued use of the App constitutes acceptance of the updated Terms.

13. Termination

You may stop using the App at any time by deleting it from your device.

We may suspend or terminate access if these Terms are violated.

14. Geographic Availability

The App is operated from Denmark and primarily intended for users within the European Union. Users outside the EU access the App at their own risk and must comply with local laws.

15. Accessibility

We strive to make the App accessible to all users. If you encounter accessibility issues, please contact us and we will attempt to provide assistance.

16. Feedback

Feedback or suggestions you provide may be used by us without restriction or compensation.

17. App Store Terms

If you download the App through Apple App Store or Google Play, their respective terms also apply.
